1. Introduction
Welcome to MotoBites (“MotoBites”, “we”, “us”, “our”). These Terms & Conditions govern your access to and use of the MotoBitesmobile application, website, and related services (collectively, the “Platform”).
By creating an account, placing an order, or using our services, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. Nature of Service
MotoBites is a technology platform that connects:
- Customers (Users)
- Restaurants/Vendors
- Delivery Riders
MotoBites:
- Facilitates ordering and payments
- Coordinates delivery logistics
MotoBites does not prepare food and is not responsible for food quality or hygiene, which remains the responsibility of Vendors.
3. Eligibility
To use MotoBites, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding contract
- Provide accurate and complete information
4. Account Registration
- You are responsible for maintaining the confidentiality of your account
- All activities under your account are your responsibility
- We may suspend accounts for fraudulent or abusive behavior
5. Orders & Payments
- All orders are subject to acceptance by the Vendor
- Prices and availability may change without notice
- Payments must be made via approved payment methods
- Orders cannot be modified once confirmed
6. Delivery
- Delivery times are estimates only, not guarantees
- You must provide an accurate delivery address and be available to receive orders
- Failure to receive delivery may result in order cancellation without refund
7. Cancellations & Refunds
Orders may only be cancelled within a limited timeframe.
Refunds may be issued if:
- Vendor cannot fulfill the order
- Payment was successful but order failed
Refund timelines depend on payment providers.
8. Vendor Responsibilities
Vendors are solely responsible for:
- Food preparation and safety
- Accurate menu listings and pricing
- Compliance with applicable health regulations
9. User Conduct
You agree not to:
- Place fraudulent or fake orders
- Abuse riders, vendors, or support staff
- Attempt to hack, disrupt, or misuse the platform
10. Limitation of Liability
MotoBites shall not be liable for:
- Food quality or health-related issues
- Delivery delays due to traffic, weather, or external factors
- Third-party payment failures
To the maximum extent permitted by law, MotoBites' liability is limited to the value of the order.
11. Intellectual Property
All content, branding, and technology on MotoBites are owned by MotoBites and may not be copied or reused without permission.
12. Suspension & Termination
We may suspend or terminate accounts that:
- Violate these Terms
- Engage in fraud or abuse
- Pose risk to the platform
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
14. Changes to Terms
We may update these Terms periodically. Continued use of the Platform constitutes acceptance of the updated Terms.
